In a big jolt to seven-time MLA from Dwarka constituency, Pabubha Manek, the Gujarat high court on Friday declared his victory in the 2017 assembly polls as void due to defective nomination.
Manek has lost his win to a small mistake committed by his proposer while filing nomination where he had failed to mention Manek’s name as well as name and number of the constituency in the first line of the form. The proposer had erroneously mentioned his own name instead. The high court has considered this absence of vital information in the form a defect of “substantial character” which rendered his nomination illegal. The court hence declared the outcome of the election as void.
