The Bombay High Court granted bail to a 22-year-old man in a sexual assault case involving a minor, observing that the 15-year-old girl was fully capable of understanding the consequences of her actions. The court noted that the girl had allegedly eloped with him voluntarily and their physical relationship was consensual
"Facts of the present case indicate that prosecutrix (girl) had sufficient knowledge and capacity to know the full import of what she was doing and had only thereafter voluntarily joined the applicant (man)," the court said.
